The above-named guest, hereinafter referred to as Guest, by signing this release document, hereinafter referred to as the Agreement, does hereby consent to audio and video recording and the distribution, duplication, and reproduction of Guest’s audio, video, and image as part of the “Proactive Caregiver” podcast, hereinafter referred to as the Podcast. The Production is produced and distributed by Cannon Light Media, LLC. hereinafter referred to as the Company.

 

The Guest does hereby acknowledge that the Company is the sole owner of all rights in and to the Podcast and the audio and video recordings thereof, for all purposes; and that the Company has the unfettered right, among other things, to put to good use, utilize and distribute the Podcast and Guest’s performance as embodied therein, together with Guest’s name, sobriquet, biographical sketch, photographs, or likeness (including, without limitation, any photographs or other material provided to the Company and the Podcast by Guest), in any and all media or formats, throughout the universe, in perpetuity. Any materials prepared by the Company for the Podcast in the course of production and distribution of the Podcast become the property of the Company and the Podcast shall have the sole and exclusive right to use, utilize, and distribute such materials, throughout the universe, in perpetuity.

 

Nothing contained in this Agreement shall be construed to obligate the Company to use or harness any of the rights granted or acquired by the Podcast or to make, sell, license, distribute, or otherwise harness the Podcast or materials whatsoever.

 

Guest understands and agrees that Guest shall receive no compensation for appearances on and participation in the Podcast.

 

Guest’s name, likeness, audio, and photography may be used in connection with the Podcast and in promoting and advertising material for the Podcast, but not as an endorsement of any product or service that the Guest may provide.

Guest hereby releases and discharges the Company and the Podcast from any and all liability arising out of or in connection with the making, producing, reproduction, processing, exhibiting, distribution, publishing, and transmitting by any means or otherwise using the above-mentioned production.

 

The Guest does hereby certify that the Company and the Podcast may utilize or not as they choose in their sole discretion without affecting the validity of this agreement.

 

Guest may be provided with a copy of the audio and or video of the Podcast after publication upon request by Guest.

 

The Guest does hereby certify that the Guest is over the age of eighteen and that the Guest has read, understood, and agreed to the foregoing.
